SUMMARY OF REPRESENTATIVE VERDICTS AND SETTLEMENTS
As part of an evaluation process, we believe it reasonable and prudent
for anyone searching for a law firm to look at the kinds of cases that
the law firm has handled in the past and its track record of verdicts
and settlements in those prior cases. While we cannot and do not guarantee
a recovery or a successful result in any case, we provide this summary
of representative cases in which CONLEY GRIGGS LLP lawyers have been directly
involved in a verdict or settlement so that you can see the kinds of cases
we have handled and some of the results we have been able to obtain for
previous clients. Please note that for many of the representative settlements
below, we can only provide summary information because the cases are subject
to private agreements and in many cases, the Defendants insisted upon
confidentiality of terms as a condition of the settlement. Also, understand
this is by no means a complete listing of every case which we have handled,
but is a summary to provide some tangible examples of how our dedication,
integrity, courage and compassion has led to successful outcomes for previous
clients we have represented.
AT CONLEY GRIGGS, LLP (March 2004-present)
JURY VERDICTS
Romeo v. AHD International, LLC – January 11, 2005 –
$1,768,458.75 Judgment
Conley Griggs LLP served as lead trial counsel in this business torts
case involving claims of breach of fiduciary duty, breach of contract,
and punitive damages, which was tried in Fulton County (Ga.) Superior
Court. The jury rendered verdict in favor of our clients in the amount
of $1,472,478 (plus attorneys fees and expenses awarded by the Court in
the amount of $295,972.75), for a total judgment of $1,768,458.75.
Taylor v. D.A. Edwards & Co., Inc., et. al. – October
1, 2004 – $260,000 Judgment
Conley Griggs LLP served as lead trial counsel in this case involving
a serious motor vehicle collision that resulted in severe leg injuries
to our client and nearly $50,000 in past and future medical expenses,
which was tried in Fulton County (Ga.) State Court. The jury rendered
a verdict against the striking driver, Fidel Borja, in the amount of $260,000.
A trial court ruling on a directed verdict in favor of the other defendants
is presently on appeal.
SETTLEMENTS
Examples of recent settlements include:
- a $900,000 settlement in a case arising from a construction site accident
in which a large piece of machinery tipped over and fell on our client’s
foot, ultimately resulting in a below-the-knee amputation. (October
2004)
- a confidential settlement of a wrongful death and personal
injury case arising from allegations that the negligent design of a
hotel stair system caused our client’s decedent to fall and suffer
fatal injuries and also caused his wife, who also fell at the same time
and location, to suffer serious personal injuries. (December 2004)
- a confidential settlement of a products liability case involving
a Ford Explorer rollover that occurred after our client swerved to avoid
a bedliner on a paved road, resulting in serious orthopedic injuries.
(March 2005)
- a confidential settlement of a wrongful death case arising
from a motor vehicle collision involving allegations that negligent
maintenance/repairs by a tire retailer and negligent driving after the
consumption of alcohol by the driver of another vehicle combined to
cause the death of our client’s teenage daughter. (March 2005)
- a $550,000 settlement in a case arising from a motor vehicle collision
in which the Defendant’s son crossed the center line and struck
our client’s vehicle head-on, causing serious orthopedic injuries.
(June 2004)
- a confidential settlement of wrongful death case arising
from a collision between a tractor-trailer and a vehicle in which our
client was a passenger. (April 2004)
AT CONLEY, SACKS & GRIGGS, LLP (March 2001-March 2004)
VERDICTS
Hansen v. W.A. Craft Corp. – February 2003 -- $337,000 Judgment
Richard Griggs served as lead trial counsel in this case arising from
a collision between a commercial van and our client, a pedestrian, which
resulted in orthopedic injuries. The case was tried to a bench verdict
in Gwinnett County State Court.
Marte v. United Waste – October 2002 -- $1,298,696 Jury
Verdict
Cale Conley and Richard Griggs served as co-lead counsel in this case
arising from a collision between a garbage truck and a vehicle in which
their clients were traveling, which resulted in injuries to all occupants
and serious head and facial injuries to an adolescent child. The case
was tried in Dekalb County (Ga.) State Court and was settled after the
jury’s verdict pursuant to a high-low agreement entered into by
the parties.
Norton v. Architectural Stone, Inc. – April 2002 –
$1,824,916.44 Judgment
Cale Conley served as lead trial counsel in this case, which involved
serious orthopedic injuries suffered by a client after a piece of granite
fell on him at a jobsite. The case was tried to a bench verdict before
the Honorable Hugh Lawson, District Judge, United States District Court
for the Northern District of Georgia (Athens).
SUMMARY OF SETTLEMENTS
- A $2,650,000 settlement of a commercial vehicle case in West Virginia
involving a collision between a flat bed tractor-trailer and our client’s
vehicle, which resulted in a brain injury and permanent injury and disfigurement
to our client.
- A $1,500,000 settlement of a commercial vehicle, wrongful death case
against a trucking company which involved a collision between a tractor-trailer
and our client’s decedent’s vehicle, which resulted in the
death of a fifty-six year old woman.
- A $1,200,000 settlement of a commercial vehicle, brain injury case
against a trucking company which involved a collision between a tractor-trailer
and our client’s vehicle, resulting in brain injury and serious
personal injury.
- A confidential settlement of a products liability case against
Kia Motor Company on behalf of a woman and her family who suffered severe
injuries as the result of a collision alleged to be caused by defects
in the components related to the fuel pump electrical circuitry system
in a Kia Sephia.
- A confidential settlement of a products liability case against
Ford Motor Company and Goodyear Tire and Rubber Company on behalf of
a passenger who suffered serious orthopedic injuries after a tire separated
and the Ford Explorer in which she was a passenger rolled over.
- A confidential settlement of a products liability case against
Mitsubishi Motors Company on behalf of a driver involved in a rollover
of a Mitsubishi Montero Sport who suffered serious injuries to her head
and arm;
- A confidential settlement of a construction site incident,
wrongful death case against a local crane company in which our client’s
decedent died after a long metal beam was dropped and struck him in
the head.
- A confidential settlement of a premises liability, wrongful
death case involving the shooting death of our client’s son at
the hands of the manager of a local convenience store/gas station.
- A confidential settlement of a personal injury case in New
Mexico against a railroad company for alleged negligence causing a severe,
multi-vehicle collision that resulted in serious leg injuries to our
client.
- A confidential settlement of a products liability case against
Ford Motor Company, Bridgestone/Firestone, Inc., and Bridgestone Corporation
in West Virginia, arising from a tire failure and rollover involving
a Ford Explorer, which resulted in a brain injury and serious internal
injuries to our client.
PRIOR TO FORMING THEIR OWN FIRM (1995-2001)
Prior to beginning their practice together, Cale Conley and Richard Griggs
were also directly involved in a number of significant matters that provided
them valuable experience that they bring with them to cases today.
While an associate at Butler, Wooten, Overby & Cheeley (now Butler,
Wooten, Fryhofer, Daughtery & Crawford), Cale Conley was directly
involved in a number of significant cases, including:
- The trial and appellate briefing in Six Flags v. Time Warner et.
al., a business torts/breach of fiduciary duty case tried in Gwinnett
County, Georgia, which resulted in a Georgia record $454 million jury
verdict for the Plaintiffs he helped represent and became the largest
verdict ever affirmed by a Georgia appellate court;
- The trial of Rodriguez v. Suzuki Motor Co., a products liability
case tried in St. Louis, Missouri, which resulted in a $36.9 million
jury verdict on behalf of a passenger who was rendered a quadriplegic
in a Suzuki Samurai rollover;
- The trial of Maucere v. Thompson Trucking, a commercial vehicle
collision case tried by Cale Conley and Richard Griggs in Fayette County
State Court, which resulted in a $190,000 verdict for their client –
a verdict which, at the time, was the largest verdict ever rendered
in that court;
- The lead role in the investigation and litigation of Caraway v.
Turner Sports, a construction site incident, wrongful death case
which arose from a death during the construction of Phillips Arena and
resulted in a confidential settlement;
- An active role in the investigation, litigation and settlement of multiple
automobile products liability cases involving vehicle rollovers, seat
belt failures, lack of crashworthiness, and other component defects.
While an associate at Downey & Cleveland and then as a senior associate
at Butler Wooten, Richard Griggs was also directly involved in many significant
cases, including:
- At Downey & Cleveland, where he practiced for over four years, the
defense of approximately 25 cases tried to jury verdict involving motor
vehicle collisions, allegations of medical malpractice or other allegations
of negligence;
- At Butler Wooten, the trial of Maucere v. Thompson Trucking,
a commercial vehicle collision case tried by Cale Conley and Richard
Griggs in Fayette County State Court, which resulted in a $190,000 verdict
for their client – a verdict which, at the time, was the largest
verdict ever rendered in that court;
- At Butler Wooten, an active role in the investigation and litigation
of a case against Isuzu Motor Company involving a seat belt failure
that resulted in a driver being transected in a rollover incident, which
case was later resolved by a confidential settlement;
- At Butler Wooten, an active role in the investigation and litigation
of a seat back failure case against DaimlerChrysler resulting in serious,
profound and permanent brain injuries to a young girl, which case was
later resolved by a confidential settlement;
- At Butler Wooten, an active role in the investigation and litigation
of a tractor-trailer wreck that resulted in the death of a Midwestern
woman and serious injuries to her husband as they were traveling through
Georgia on their way to Florida, which case was resolved by a confidential
settlement;
- At Butler Wooten, an active role in the investigation and litigation
of a case involving claims of sexual and physical abuse of an adolescent
boy at an all-boys military academy, which case was resolved by a confidential
settlement;
- At Butler Wooten, an active role in the investigation and litigation
of a case where an elderly woman received life-threatening injuries
after being given the wrong medication at a local pharmacy, which case
was resolved by a confidential settlement;
