Defective Motorcycle/Bicycle Helmet Lawsuits

One of the most effective types of protective gear you can wear when riding a motorcycle, bicycle or ATV is a quality helmet. The risk of serious head and brain injuries can be reduced when a rider wears a helmet, as long as the helmet works as intended. Unfortunately, there have been instances where a helmet has a manufacturing or design flaw that reduces its effectiveness to prevent injury. When this occurs, and the rider sustains a head injury, the helmet designer or manufacturer may be liable for their injury.

Helmets are required to meet safety standards, whether they are meant for using while riding a bicycle or for motorized vehicles like motorcycles and ATVs. Something as small as a defective chin strap can fail during a crash, negating the protective features of the helmet. Riders wearing helmets expect to have head protection from their gear. When the helmet fails, the rider can face serious injuries to the head, brain, face and other features.

However, an experienced personal injury legal team will have the resources to help prove their case. Medical and safety experts can be useful to provide evidence if a defect in a helmet was the likely cause of a head injury. If a helmet has been recalled due to safety issues, it can be easier to prove the case. Some defective helmets that have come under legal scrutiny due to serious injuries include:
